Dougherty Lake Trustees Meeting
October 30, 2004

Minutes
Minutes from the September 18, 2004 meeting were approved.

Treasurer’s Report
Paul reported that fund balances are $105.58 in the working bill-paying account, $33,400.00 in money market, and $10,006.20 in lake reserve. Figures for the fiscal year ended September 30 show expenses of $32,327, or $148 under the budget of $32,475. Kalb Electric has not billed for street light repairs; expenses over budget include unbudgeted playground renovation ($1,000). Over budget were lake chemicals ($600 over) and electricity ($400 over). Electricity has increased significantly since 2002, due primarily to the aerators in the lake.

Budget for Oct. 1, 2004 to Sept. 30, 2005 is $36,564 and shows a projected surplus of $100, based on an assessment of $195 per home, up $5 from 2004. The budget includes two leaf pickups. A possible major upcoming expense is painting of the Des Peres Road fence, estimated at $5,000, which is unbudgeted.

Lake/Maintenance

  • Jim Gruenewald said that one of the aerators has been down and is being repaired. While this is the situation, the remaining aerator has been run 24 hours a day.
  • Aerator pumps will be removed for the winter and placed in a storage facility, to protect them from winter damage.
Landscaping
Nancy reported on the following:
  • Des Peres, above-retaining-wall project: The City of Des Peres will grind the stumps. There has been a delay due to determining how to get stump-grinding equipment into the area.
  • Leaf pickup:  The first leaf pickup went well. However, Nancy noted that many homeowners (32) were counted to have raked their leaves into the street, against the direction of the subdivision. She showed a map of the subdivision storm drain system from MSD. A large portion of the storm sewers in the subdivision drain into the lake. When leaves, grass clippings and other wastes are washed into the lake, it adds to the silt problem. Organic waste decomposes, prevents oxygen circulation, and promotes the growth of algae. When we place more organic waste into the lake and increase siltation, we decrease the health of the lake and bring us closer to a very costly dredging operation. She asked that the next subdivision newsletter include a reminder to not discard anything into the storm sewers.
  • Irrigation:  Nancy reported on irrigation expenses for the year. A number of pop-up sprayers at the front entrance were run over or vandalized. At the playground, two spray heads had to be replaced and two others moved because their spray paths were blocked.
Annual Meeting
Rich reviewed the agenda for the November 16 annual meeting. He asked that reports be kept brief.

Trustees
Two residents have agreed to stand for election to the two vacancies. They are

  • Steve Askren of 2405 Hollyhead
  • Jim Harris of 775 Haw Thicket.
Next Meeting
A joint meeting of incoming and outgoing trustees will be set after the annual meeting.

Dougherty Lake Trustees Meeting
September 18, 2004

Minutes
Minutes from the June 12, 2004 meeting were approved.

Treasurer’s Report
Fund balances are $1,796.44 in working bill-paying account, $38,972.67 in money market, and $10,093.99 in lake reserve. All homeowner assessments have been paid for 2004. 

Landscaping
Nancy reported on the following:

Entrance Bed:  Symmetry Landscaping replaced dying shrubs. Mums were to be installed to replace begonias for the fall.

Des Peres Road Easement (north of entrance):  To address concerns about erosion and mud washing onto the sidewalk, Symmetry this fall will plant grass seed in the area between the fence and the sidewalk. They also will clear lower branches of trees to allow for more light. The cost for seeding is $144; the cost for raising the trees is $100. The City of Des Peres will be planting three maple trees to fill in gaps.

Des Peres Road Easement (south of entrance):  Des Peres is proceeding with clearing brush from above the retaining wall. Desirable trees are being saved. Chipped debris will be spread to control erosion. The subdivision will landscape the area in 2005.

Cul-de-sacs:  Nancy and Symmetry inspected the landscaping in subdivision cul-de-sac islands and found the following:
    - Briar Fork Court could use about six small shrubs in a bare area; estimated cost $240. Trustees approved the expenditure.
    - Hollyhead Drive contains two Manhattan Euonymus shrubs with excessive size. These were cut back to the roots; if they do not grow back, a few new shrubs can be planted in their place.
    - On Camberwell Court, a Parrotia tree will be planted.

Other cul-de-sacs seem in good shape. The Garden Club will consider planting bulbs in the cul-de-sacs as a beautification project.

Playground Area:  The failing maple tree will be removed, and two dead box elder trees in the wood line will be removed, at a cost of $425. The park bench under the maple tree will be relocated to the east end of the playground for $188.

Tropical hardwood lumber has been ordered for the park benches. Fred Shaffstall has volunteered to do the installation with Rich Dugge assisting.

The concrete slab under the picnic tables has turned partially black with mildew. Doug Stevens will use his power washer to clean it up.

The Garden Club had an attractive boulder sign installed at the Garden by the Lake in July.

Betty Struckhoff is planning to organize a work group to begin clearing bush honeysuckle from the common ground woods on Saturday, November 27, in anticipation of the Des Peres limb pickup on November 29-30.

Leaf Pickup:  Based on input from the trustees and Garden Club members leaf pickups have been requested for the weeks of October 25 and November 15. 

Des Peres Limb Pickup:  The City of Des Peres will conduct its annual limb pickup in the subdivision on Monday and Tuesday, November 29-30.

Lake/Maintenance
Jim Gruenewald suggested that next year the subdivision budget for an inspection of the lake tunnel that runs from the outlet to the discharge area south of Beaver Dam.

Several street lamps remain unrepaired. Kalb Electric also has been very slow to provide invoices for previous work.

Trustees
Jim Braibish announced that he is resigning from the trustees at the conclusion of this year, due to personal and business concerns. This, in addition to the completion of Rich Dugge’s term, will open two positions on the trustees.

Annual Meeting
November 16 was set as the tentative date of the annual meeting. A mailing will be sent to residents in early October containing the meeting notice, a request for trustees and a flyer on the leaf pickup.

June 12, 2004

Minutes
Minutes from the April 10, 2004 meeting were approved.

Treasurer’s Report
Fund balance is $21,411.35 plus $10,000 lake reserve. All homeowner assessments have been paid for 2004 except for 20 homes.

Landscaping
Playground:  Renovation work is almost complete. New mulch has been installed. The playground equipment has been power-washed and re-stained. A new canopy has been received and will be installed this week.

Camberwell Court:  Symmetry Landscaping will remove two dead trees on the island. Trustees approved planting a Parrotia tree there in the fall; this tree was recommended by Symmetry for its durability.

Mud on Des Peres Road sidewalk (north of Beaver Dam):  A proposal to plant ground cover along the fence was rejected as too costly; Nancy will check with the City of Des Peres on its recommendations since this an easement.

Retaining wall along Des Peres Road (south of Beaver Dam):  The City of Des Peres will clear nuisance plants from the area with the understanding that the subdivision will be responsible for maintaining it. Clearing probably will take place in September. The Parks Department will mark desirable trees and plants to be kept. Nancy will conduct further discussions with Symmetry to identify possible ground-cover solutions at a reasonable cost.

Garden Club
20 people including several trustees attended the June 3 Garden Club tour.

Leaf Pickup Survey
Nancy presented results of the leaf pickup survey included in the spring newsletter. Sixty-seven of the 187 households in the subdivision responded. Responses to the question about preferred number of pickups are as follows:
 0 leaf pickups   25%
 1 leaf pickup   8%
 2 leaf pickups  65%

Nancy also shared the verbatim comments supplied with the survey. Those favoring two pickups generally appreciate the service, and those opposed to leaf pickup concerned about leaf accumulation along the streets and duplication with the city’s yard waste pickup.
Trustee discussion focused on concern about whether subdivision funds should be spent on leaf pickup versus maintenance and improvement of common grounds, as well as the number of pickups needed to effectively take care of leaf removal. Jim Gruenewald will check with Symmetry about options for homeowners contracting individually for the service. A decision was tabled until a special meeting of the trustees in July.

Lake/Maintenance
Jim Gruenewald reported that the aerator and bubbler have been repaired and are working.

Over Memorial Day weekend, he cleared a large accumulation of debris from the lake outlet grate. Heavy debris had piled up from storms that week and potentially could have clogged the outlet.

Registration
Paul is checking into legal registration options for the subdivision, and whether federal filings are required and whether the subdivision can qualify as exempt from state sales tax.

Communications
A fall newsletter issue was requested. An appeal for candidates to apply for the board would be included.

Anonymous Complaint
Rich presented an anonymous letter he received. The letter expressed concerns about low-hanging trees, dogs and other nuisances at several specific addresses. The letter will be forwarded to the City of Des Peres.

Property Insurance
Trustees rejected a proposal to purchase property insurance for common grounds, that would cover signs, fencing, street lights, playground equipment and lake fixtures. It was felt that the $983 annual cost was not justified against the low potential for losses on these items.

Next Meeting
A meeting will be scheduled in early July to determine action on fall leaf pickup.

Treasurer’s Report
Report approved; all expenses on budget.

Landscaping
Nancy conducted an initial review with Symmetry of three potential projects: clearing the wild growth above the retaining wall on Des Peres Road south of the subdivision entrance; renovating the playground mulch; and preventing the accumulation of mud on the Des Peres Road sidewalk in several sections north of the subdivision entrance. She will investigate the projects further and report back to the trustees. There is possibility the city could assist with the weed-clearing project; trustees also expressed concern that whatever replaces the weeds should not be vulnerable to erosion. 

Lake
Jim G. is working on addling goose eggs, and arranging for the flight control treatment. He will be meeting with Lee Redman to check on needs to prevent siltation.

Communications
Jim B. reported that Web site updates have been completed. A newsletter will be produced in April. Packets of information were distributed to several new residents.

February 7, 2004

Minutes
Minutes from the December 6, 2003 meeting were approved.

Treasurer’s Report
Account balances as of February 6, 2004 are:  checking, $107.67; operations fund and reserves, $23,532.12; lake reserve, $10,047.41.  Expenses for the fiscal year ended September 30, 2004 are projected to be $32,636 and within budget. 

Homeowner Assessment
To analyze financial trends, Paul presented lists of expenditures for the fiscal years 2000-2001, through 2004-2005 (projected).  These lists include regular expenditures such as landscape maintenance and utilities, as well as one-time expenses. In 2004-2005, projected expenditures would exceed revenues by almost $1,000. 

Motion was passed to increase the assessment to $190 per home in 2004, an increase of $5 from the current $185.  [The Restrictive Agreement empowers the trustees to increase the assessment by no more than the cost of living since the last increase.]  The amount of the increase is less than the rise in the cost of living since 2000, when the assessment was last increased.  Reasons given for the increase are:

1) The subdivision should stay in a position in which revenues meet or slightly exceed expenditures, rather than fall behind in revenues.
2) We should maintain the level of services currently being provided rather than reducing services.
3) Through prudent management, we have held the line on increases while absorbing rising utility and insurance costs. A major cost savings was achieved in 2003 through a new landscaping contract. The assessment has not been increased for three years.
4) Funds should be available for future maintenance work such as street lamp repair and fence painting.
Landscaping

Nancy presented a proposed landscaping budget for calendar 2004.  Symmetry Landscaping, the vendor, receives a 2% increase as provided for in the contract signed last year.  Total landscape costs in calendar 2003 were $12,766; for 2004 they would be $10,893 to $14,795 depending on the number of leaf pickups provided. [Note: The subdivision budget is on an October 1 to September 30 fiscal year; these landscaping costs are presented for the calendar year.]

Regarding leaf pickup, a survey will be included in the next subdivision newsletter to gauge resident attitudes about continuing or expanding the leaf pickup.

The area around a retaining wall along Des Peres Road south of the subdivision entrance has been noted as being in need of maintenance.  Most of the section above the wall and outside the fence is on the homeowner's property, however it is inaccessible to the homeowner. The wall and the ground below it are city property. Nancy will request a proposal from Symmetry on costs to clear weeds from the wall and area above it, and to install some basic plantings. She also will check with the city to see if it would put the plantings in the wall. 

Honeysuckle growing at the edge of the woods adjacent to the playground is a concern.  The plant is not native and spreads quickly. Treatment to remove the honeysuckle is targeted for November 2004; we are told that early November is the best time to treat the honeysuckle.

The Garden Club is working on converting the sign at the Butterfly Garden, from a stake sign, to one mounted on a large rock. The Garden Club will pay the estimated $200 cost.

Nancy and Rich will look into a situation of large amounts of mud collecting on the Des Peres Road sidewalk, at a location several houses north of the subdivision entrance. 

Lake/Maintenance
Jim Gruenewald is checking on companies to perform treatments to prevent silt development in the lake.  He will work with homeowners around the lake to gain their participation in goose control treatments.

Arrangements were made to begin replacing burned-out street lights after the ice and snow melt.

Trustees approved installation of a second “No swimming. No boating. No skating” sign by the lake along Beaver Dam, toward the eastern shore. A similar sign would be placed above the lake inlet at the north end. Sign postings are necessary to minimize liability.

Communications
Jim Braibish said a newsletter would be produced during February.  Articles will include:

  • announcement of assessment increase
  • reports from 2003 annual meeting
  • large amount of wildfowl, wildlife and aquatic life at the lake
  • photos and profiles of the trustees
  • explanation of the major provisions of the Restrictive Agreement requiring trustees’ approval of fences, building modifications, etc.
  • article about the Garden Club and other clubs.
Joe Odgers will continue maintaining the Web site.  Jim B. supplies information for updating.  A series of updates, including the newly adopted Restrictive Agreement, and the new trustees, will be posted soon.

December 6, 2003

Minutes
Minutes from the November 8 meeting were approved.  A draft of the November 18 annual meeting minutes was circulated for review.

New Indentures 
Revised Restrictive Agreement was approved at the annual meeting.  The official copy with trustee signatures has been filed with St. Louis County.

Election of Officers/Assignment of Duties
Rich Dugge was elected to serve as chair for the 2004 year.  Paul Shaver will continue as treasurer; Jim Braibish with communications.  Nancy Shaffstall will handle landscaping and Jim Gruenewald will serve with lake and maintenance.

Treasurer’s Report
Paul presented updated budget reports and cash flow projections for the 2000-01 fiscal year through the 2004-05 fiscal year.  Regular expenses of the subdivision (landscaping, administration, etc.) were $22,175 in 2000-01 and are projected at $25,559 for 2004-05.  Routine maintenance (street lights, lake aerators) ranges from $1,000 to $6,000.  Improvement projects vary from year to year and have included lake repair $34,886 in 2000-01, and front entrance bed updating for $2,000 in 2003-04. 

To help in projecting financial needs for the subdivision, trustees were asked to consider projects that may require budgeting.  Items mentioned include:  re-anchoring the lake aerator/bubbler, repainting and repairing rusting street lamps, making selective improvements to cul-de-sac islands, removing bush honeysuckle by the playground, repairing a fence by the lake inlet, adding a second leaf pick-up, and painting the Des Peres Road fence.  At this time, these are only items being considered; no final decision has been made.  The purpose of the discussion is to help determine whether dues should be retained at $185 or increased.

Lake/Maintenance
The aerator and bubbler on the lake have been turned off for the season.  Arrangements will be made to repair damaged slats on the Des Peres Road fence behind 740 Stump.  Because the damage apparently was caused by mowing, Symmetry will be asked to make the repair.

Landscaping
Renovation of the flower bed at the front entrance has been completed.  Services will continue to be provided by Symmetry in 2004.

Treasurer’s Report
Treasurer’s report was approved.  Expenditures for the fall picnic were within budget.

Landscaping
Leaf pickup will be conducted the week of November 10.  Work has begun on renovating the flower bed at the front entrance.

Annual Meeting
Agenda for the November 18 annual meeting was discussed.  Reports will be presented on landscaping, maintenance and the lake, along with a financial report.  The revised subdivision indentures will be voted upon using paper ballots..  Election will be held for new trustees.

Trustee Candidates
Only one indication of interest has been received in volunteering for the two open positions on the 2004 board.  Jim will send out an e-mail inviting residents to consider presenting themselves as trustee candidates.

Dougherty Lake Trustees Meeting
August 9, 2003

Treasurer's Report
Bank accounts have been opened at USBank per action of last meeting.  Previous accounts at First National Bank will be closed.  USBank offers better service and higher rates of return on deposits.  A treasurer's report and budget projection were presented.  A total of $32,333 in assessments has been received through June, leaving an estimated $310 not received. 
Paul reported a request from the social committee for funding to stage the fall picnic.  He will contact the party committee to work out details.

Insurance
Approval was given to purchasing director/officer insurance for the trustees.  This insurance will also protect committee members and volunteers who work on Subdivision projects.   Coverage is $2,000,000 total for annual premium of $1,234.    It is felt that this coverage is needed to protect both the trustees and Subdivision committee members from damage claims and nuisance lawsuits.  Without a reasonable level of  protection, some of our able residents may decline to serve as a trustee or help out on committees.

Maintenance & Lake
Mike and Rich are working on solutions to repair the anchoring for the bubbler.  They also are working on repairing wiring to the front entrance lamp; various solutions are under consideration.

Complaints Regarding Indenture Violations
The trustees discussed complaints regarding a fence installation, and the parking of a trailer on gravel in a back yard.  Action steps were determined.

Indentures Committee
Rich reported on the progress of the special committee on the indentures.  The committee has meet and completed its markup of a draft that consolidates the original 1972 indentures with the nine amendments approved since then.  No changes in the intent of provisions have been made; the task simply has been to clean up and consolidate.   A completed draft will be presented to the trustees within several weeks.  The indentures document will be presented for vote at the annual meeting in November; it will be mailed to residents 30 days prior to the meeting along with an explanation that this document is a consolidation and not a revision.

Trustee Nominations
Trustee members will continue encouraging others to consider candidacy for positions on the board up for election in November.

Dougherty Lake Trustees Meeting
June 14, 2003

Present: Jim Braibish, Bob Butterworth, Rich Dugge, Mike Lohuis, Paul Shaver

Minutes of the April meeting were approved with amendments.

Des Peres Police
Sgt. John Preuss of the Des Peres Police Department attended the meeting as part of a police effort to visit all subdivision board meetings in the city and establish dialogue between the police and subdivision boards.  He encouraged trustees and residents to check the city Web site www.desperesmo.org and sign up for e-mail updates; he also said the police always are responsive to input from residents.  In response to questions, he said the incidence of burglary in the city is generally low, due in part to efforts by the police to monitor organized, traveling rings.  Youth problems at the new West County mall have been minimal compared to other malls; the lack of a movie theater or game arcade makes it less attractive.  Trustees said there are no current concerns in the subdivision, although there is some incidence of speeding and failure to stop at the Beaver Dam stop sign.  In the past there have been occasions of large youth gatherings near the lake.

Subdivision Indentures
Rich was appointed to chair a committee concerning the subdivision indentures (“Restrictive Agreement”) and Jim will serve on the committee.  The purpose will be to compare the original 1972 indentures and amendments, with a simplified language indentures document that has been circulated during the past several years.  The committee will present a recommendation to the residents concerning what should be the official set of indentures.  The purpose at this stage is not to amend the intent of any provision of the indentures, but simply to clarify language. 

Landscaping
Mike presented a proposal from Symmetry Landscaping to update the plantings at the subdivision front entrance and improve their appearance.  New plants proposed would include gold potentillas, boxwoods and an additional lilac tree.  The trustees authorized Mike a budget of $2,000 to work out the best plan with Symmetry.  Most of the planting work would take place in the fall after the hot weather passes.

Financial Report
Paul presented a projected budget for the fiscal year ending September 30, 2003.  Revenues, almost entirely from resident fees, will total $34,535.  Expenses are projected at $33,849, leaving net revenues of $686. 

Paul is soliciting proposals for director insurance for the trustees. 

The trustees voted to move the subdivision's banking to USBank from First National Bank after Paul presented information on the rates and fees of those two banks and two others.  USBank offers the highest interest on deposits, the lowest fees and better service features.

Fountain Repair 
The fountain in the lake was repaired in April at a cost of $810.  Most of the cost, $500, will be reimbursed by the manufacturer, Otterbine.  Reimbursement check has not been received yet.

Lake
Trustees authorized $145 for chemicals to apply a “power pond” treatment to help minimize organic growth on the floor of the lake.  This helps to keep the lake from forming algae and developing silt that would require costly dredging.

Trustee Elections
Bob reminded trustees that his and Mike's terms will expire in November.  He suggested that members encourage qualified individuals to run for election.

Other
Jim presented a list of story topics for a subdivision newsletter.

Paul raised a question about discouraging regular on-street parking.  It was suggested that an item be included in the newsletter reminding residents to try to avoid parking on the streets.

Dougherty Lake Trustees Meeting
April 12, 2003

Landscaping
The landscaping contract with Symmetry has been signed for $11,551.84, including all services provided in previous years plus one round of curbside leaf pickup.  The arrangement is for three years, with 2% increases in 2004 and 2005.

A separate expenditure of $923 was approved for Symmetry to plant annual flowers at the subdivision entrance.  Mike will check with Garden Club members for input on a future redesign of the front entrance.

The irrigation system at the entrance and at the subdivision park has been started and tested for an expenditure of $220.

Goose Control
Mike attended a Missouri Conservation Department seminar on goose control.  Controlling geese is difficult, since once a goose establishes laying its eggs in a certain location, it will continue to use that location for its 20-year life span.  The goose population can be limited by preventing the eggs from hatching.  A spray can be applied to do this.

An expenditure of $147 to Symmetry was approved for one spraying of the common ground around the lake. 

Financial Report
All payments are current and all 2002 homeowner assessments have been paid.  A budget update is being worked on.

Lake
The fountain and aerator are in operation from 8 a.m. to 8 p.m. daily.  An expenditure of $650 was approved to apply a treatment to the lake for control of aquatic weeds, algae and moss.

Restrictive Agreement
A committee of trustees and residents will be formed to present recommendations concerning the restrictive agreement.  The official document in force is the original agreement with amendments adopted over the years. A version with simplified language has been circulated but has not been approved; the committee will resolve what the content of the document should be; any revisions must be approved by the residents.

Dougherty Lake Subdivision Board of Trustees Meeting
February 15, 2003

Lake Update

The fountain and aerator, now shut off for the winter, will be turned on when the weather warms.  There is concern that the fountain may need replacement of the electrical cable similar to the work previously done on the aerator. 

Landscaping Contract

Mike presented proposals from Horstmann Brothers and Symmetry for maintenance of common area landscaping.  Each contained an itemized list of proposed services per Mike's RFP.  The playground park, lakefront and front boulevard (along Des Peres Road) would receive weekly mowing, trimming and blowing, grub control and fall clean-up.  Maintenance plants and flower beds of cul-de-sac islands, park beds and tree pockets would include early spring clean-up, pruning and bed weed control.  Miscellaneous services would include fall aeration, spraying of rip rap on the lakefront, planting of annuals at the subdivision entrance, and one fall curbside leaf pick-up for all residences in the subdivision.  The trustees felt that curbside leaf pick-up would be a desirable new service to offer residents, and is one provided by some municipalities.

Horstmann handled maintenance in 2002 after the previous contractor went out of business; their service has been acceptable.  Paul previously used Symmetry at his place of business and rated their service as excellent. 

Trustees gave tentative approval to awarding the landscaping contract to Symmetry, for $12,747.83, pending clarification of several details.  This would represent a reduction from the cost of $14,791 paid in 2002.

Trustees will consult with the subdivision Garden Club about any role they wish to play in designing/maintaining the entrance. 

Maintenance of irrigation systems is handled by a separate contractor who has provided satisfactory service.

Financial Report

Paul presented the treasurer's report.  All payments are current.  Mike will draft a projected 2003 budget based on continuation of current areas on ongoing expense.

Maintenance

The cedar fence along Des Peres Road is not in need of maintenance this year; work is needed only every 3-4 years.  Globes on the subdivision lamps will be cleaned in the fall; this is judged to be the best time because with the longer nights they are more visible.

Communications

Jim reported that the new subdivision directory is being printed by Cindi Stanley of Coldwell Banker.  It should be ready within 30 days.  Trustees will distribute the directory in order to save postage costs.

Dougherty Lake Subdivision Board of Trustees Meeting
Saturday December 14, 2002

In attendance were Bob Butterworth, Jim Braibish, Rich Dugge, Mike Lohuis, Brian L’Hommedieu and Paul Shaver.

The meeting started with a general discussion of the duties and responsibilities of the trustees. Mike talked about landscaping, lighting and lake maintenance. Brian described the job of treasurer. Bob talked about chairman/facilitator role as well as communication.  Roles selected as follows:

  • Chairman-Bob Butterworth
  • Landscaping/Maintenance-Mike Lohuis and Rich Dugge
  • Communications-Jim Braibish
  • Treasurer-Paul Shaver
The fountain is not operating.  The plan is for Rich to call Lee Redman and make arrangements for pulling the fountain out for the winter, and hopefully figure out why it is not operating. If the cable is cut, we may want to buy more cable and move it a little farther out in the lake. 

Bids have been requested for landscaping.  The front circle is also out for bid.  Proposals will be reviewed at the next meeting.  The Children’s Garden is being revamped.  The Garden Club will let us know what the plans are for the space.  The check valve for the sprinkler system at the playground is dripping.  We may want to get it fixed.  Our last water bill was over $700.00 due to an earlier sprinkler leak.

Brian reviewed the financial statement.  We are still in the black.  Paul and Brian will get together at some future date to transfer the accounts and review the billing procedures. 

An independent group of neighborhood attorneys is preparing a user-friendly version of the indentures.  Rich and Bob volunteered to work with this group.

Minutes of the Special DLS Trustee Meeting of June 19, 2002

Attendance:  John Steuterman, Michael Lohuis, Robert Butterworth.  Absent with excuse:  Carel Reynolds and Brian L’Hommedieu

1. Reviewed Statues:
  A.  Mike opened the meeting with a review of our current status concerning the aeration system. Mike and Bob explained the previous conversations and history of events. At this point, the Trustees feel there are 3 options to consideri

i.. Move the fountain out into the lake at an appropriate range and keep the 2 hp motor in the bubbler with sufficient cable to place it between 850 and 900 feet further north. 


CONCERNS: Would moving the bubbler out that distance with the current horsepower motor result in un-predictable and episodic drops of voltage to the bubbler due to normal variances of power in the area?  Would this situation result in episodic “brown-outs” causing premature failure of the bubbler motor?  These questions would be asked of Outdoor Equipment personnel for verification. 

         ii.  Replace the 2 hp motor in the bubbler with a 1 hp motor and run a lighter cable our 850 to 900 feet.

CONCERNS:  There were few concerns with this proposal as a 1 hp motor moves the same amount of water as the 2 hp motor.  The voltage drop would be smaller and possibly within a more acceptable range to prevent “brown-outs” to the motor.  Based on calculations between Mike and Bob, it was felt that there were a variety of placement options at the north end of the lake to allow the bubbler to operate effectively. 

        iii. Place a second electrical panel on the common ground between Odgers and Toedtman’s house to allow a 2-hp bubbler to operate effectively.

CONCERNS:  Cost is the biggest factor in the third decision.  None-the-less, it was felt that whatever decision was arrived at by the entire Trustees, the implementation of the aeration system must be done right, in accordance with the agreements with the subdivision.  There was not to be any shortcuts taken just to finish this job.  We agreed to expend those monies necessary to do this job correctly. 

2. Financial Discussion

a. Mike presented the bill from Crown Electrical for services rendered.  The cost over-runs were not acceptable to the Trustees.  We agreed to pay only the bid price, minus the $200.00 additional repairs to our irrigation system due to the non-functioning bore severing our main irrigation lines.
 b. Bob and Mike will represent the Trustees during the discussion on Saturday morning with Outdoor Equipment.  These two Trustees will conduct any discussions as to engineering, finances, parts replacement, etc.  Any actions to correct the problems with our aeration system will require a written proposal/site plan/cost analysis from the vendor(s) and action by the full Board of Trustees prior to implementation. 
N.B.:  The irrigation system is now working properly.

Saturday June 1, 2002

The meeting was held at Tippins Restaurant and Mike Lohuis, Bob Butterworth, John Steuterman and Carel Reynolds were present. 

Agenda: 
1. Review action items from previous meeting 

  • Bob - contacted the Wrap's about the fence construction and have not heard back. It was decided that we would send them a letter stating that either the fence is replaced or repaired by the end of June or we will take action. Bob will prepare the letter over all 5 signatures.
  • Mike – will send an article to Carel re. aerator project and geese 
  • John – will send a Sam and Angel article for newsletter re. new landscaping company 
  • Carel - include Neighborhood directory questionnaire with Newsletter.
  • Mike – fixed the lights on Haw Thicket and on Camberwell 
  • Mike reported that the geese eggs were addled and no babies are present.


2. Review interim financial picture (Brian will supply report) 

  • Everything seems on target with the exceptions missing numbers for the assessment income. Mike will ask Brian to update the budget for the next meeting.
3. Update on aerator project (Mike) 
  • The aerators are being installed June 1. 
  • John suggested that we build a box of some sort around the controls. Some would like to see a more natural look with bushes but John pointed out that they are hard to cut around. Carel and Mike will investigate a box with roof and perhaps a bulletin board for community events. Carel will call the City of Des Peres to see who built the one at Sugar Creek.
  • It was decided that we will rent a storage locker for the aeration equipment in the winter.
  • 4. Update on landscaping & irrigation 
    • Everything is on target. 
    5. Update on children's garden & front bed 
    • Carel, Mary Lee Butterworth and Betty Struckhoff planted annuals and a few perennials in the island entrance. John will ask Horstman to keep it cleaned up.
    • Carel will discuss maintenance of the Children’s Garden with the Garden Club and the Mom’s of the Children’s Garden. If they are not interested in maintaining it nicely, John will turn it over to Horstman. Carel asked for a little more time to work on it.
    • Mike reported that the conduit (from the aerator installation) in the children’s garden should be buried so that we can find it. He will work on it.
    6. Update on maintenance and fences
    • Bob reported that he has not found anyone to paint the fence along the lake by Odgers and the light pole on Briar Fork.  John also asked about sealing the basketball court.
    7. Update on lighting: All lights are working properly

    8. Newsletter: Carel is poised and ready to finish and get out. 

    9. New Business 

    • Neighborhood garage sales: It was suggested that we eliminate these in the future. 
    • The re-write of restrictive agreement that Joe Odgers put together seems fine but we would like to run it past our attorney.  We would also like to make a few additions to include verbiage about boats in the driveway, and that we do not permit any public advertisements on private property, i.e. Neighborhood garage sales. After the attorney looks at the agreement, we will send it to each homeowner asking for their input. Then, prior to the annual meeting we will send a final copy announcing that a vote will take place on the overall re-write and on each of the seperate items we wish to add.
    • It was suggested that we ask via the Newsletter questionnaire whether residents use the DL website? If so, how would they improve it? 
    • Carel will call City and Village to find out who the new homeowners are who bought the Behrent house on Haw Thicket. It seems they have a boat parked in their driveway and we need to address the issue. Bob and Mike will walk down and talk to them.

    Dougherty Lake Subdivision Board of Trustees Meeting
    Thursday May 17, 2001 7:00 PM

    This meeting was held at the home of Carel Reynolds.  Those in attendance included John Stueterman, Brian L’Hommedieu, Mike Lohuis, Bob Butterworth and Carel Reynolds.

    Neighborhood Construction
    Brian explained his Cupola restoration project, and all present approved the project.

    Brian announced that the Bill and Leah Gleasons, new residents at 12837 Beaver Dam, called him recently asking about building a playhouse and adding stonework to their home. Brian told them that they should submit drawings to the trustees and we would discuss their playhouse. To date, nothing has been received. It was decided that Carel would send them a letter asking the status of the playhouse and reminding them that they must submit a proposal.

    Treasurer’s Report
    Because his database was recently wiped out with a virus, Brian was unable to give us a complete report. He is in the process of recreating our financial statement from scratch. Our current checking balance is $1,605.13, we have $87.96 in the money market account, and $10,158.79 in the lake CD account. The projected annual income for this year is $32,174.60, which does not include interest income. Brian will work on getting the financials up to date as quickly as possible.

    Maintenance Report
    John is planning a drive through with Gerber on Friday. They will plan the next steps in trimming trees, weeding and other projects for Gerber. In addition, he will ask Gerber to look at the sprinkler system, which is failing at the park.

    John reported that the front entrance has been planted. Carel asked John to have Gerber address the common area between Odgers and Toedtman, and he agreed.

    Bob reported that the guardrail by the lake has been painted at a cost of $1946.00. We have contracted with Cedar Treatment for painting the fence along Des Peres Road for $3390.00.  They plan to start shortly after June 1.  One issue at hand is the fact that several homeowners along the fence have not removed the bushes that have grown into the fence. Bob asked them, via letter two months ago, to have it completed by the middle of May. It was suggested that Bob send another letter giving them until June 1 to complete the project. If it is not done by June 1, we will take the next steps. This is an easement and must be opened so that we can maintain the fence.

    Bob is planning, in the near future, to install an electrical outlet in the park.

    The playground equipment cover is broken. Bob will check with Charles Schrock, who repaired it the last time, and proceed with fixing it.

    Mike reported that all lights in the subdivision are currently working. Econolight recently had to replace 5 cells and 1 transformer at a cost of $437.00.

    In the last newsletter, we asked the residents to let us know how they felt about the current lights in the subdivision. The majority stated that they liked the style we have, but would like to see more light coming from them. Mike researched ways to brighten the subdivision. One issue discovered was that many homeowners’ yard lights are not working. Mike contacted Econolight and they submitted a bid to repair these lights if anyone wants to do so. Mike will send a letter to all of these homeowners giving them the information from Econolight. 

    Mike also received a proposal from Econolight to improve the lights along the streets from 2-bulb to 4-bulb fixtures.  This cost is $346.98 per light. It was decided that we should test one light in a critical area like a dangerous intersection, and see how it looks.  Mike was asked to move forward with this project.

    Lake Report
    Carel reported on the investigation of lake-aerators. We have two bids, one from Outdoor’s Inc. and one from Hydro Dramatics. We still have to obtain bids on the electrical work, but need to contact UE to find out where our nearest power source is. Mike offered to contact UE and get back to Carel. 

    Carel is still working on getting a bid for the repair of the dam under the road. She will report back. This work, in addition to cleaning the grate and repairing the concrete on the dam, can wait until next year if necessary.

    John and Mike agreed to write an article for the newsletter explaining our position with regard to the lake.  Carel will begin work on the newsletter as soon as possible.

    Garden Club Report
    Carel reported on the Children’s Garden and Garden Club. Their wish is to begin marketing the idea of the Children’s Garden to the parents and children.  If they approve the idea, the garden club will move forward with putting a formal plan together for the garden and submitting it to the trustees for approval.

    The Garden Club also asked if they could work on the cul-de-sacs one at a time with input from the homeowners who live around them.  Although we are skeptical that this will work because of the amount of work involved, we decided to let them move forward with a plan for one cul-de-sac, which should be submitted to the trustees for approval. 

    Miscellaneous Items
    The activities committee asked the trustees to consider purchasing a sign that can be used for advertising events. This was approved and Carel will investigate various signs. 

    Joe Odgers requested that we move our web site. Because of the amount of traffic our current host has, it is difficult for him to maintain the one we have. We could purchase our own, “DoughertyLake.org” for only $25 a year and have it hosted for around $10 a month. All agreed that this was necessary. Carel will ask Joe to move forward.

    Our next meeting will be held on Saturday, June 9 at 8:30 A.M. at Tippin’s on Clayton Road.

    Dougherty Lake Subdivision Board of Trustees Meeting
    Saturday February 10, 2001 7:00 PM

    Brian L’Hommedieu called the meeting to order and the following were present:  Mike Lohuis, John Steuterman, and Robert Butterworth.

    The minutes from the last meeting were approved. 

    Fence Issue
    Bob presented a report on the painting of the guardrail by Barthelmass Company for a total amount of $1946.00.  Barthelmass ($4968.00) and Cedar Treatment Services Inc. ($3390.00) submitted a bid for staining and cleaning of the Des Peres Road fence.   Bob will review each bid and he will develop a letter to the nine homeowners outlining the dates for the fence staining with their responsibilities to assist the chosen vendor.  A copy of this letter will be forwarded to the Trustees as follow-up.

    It was the decision of the Trustees not to utilize residents to stain/clean the fence due to liability concerns.  If there are small repairs to the fence that residents can assist the subdivision, Bob will notify appropriate individuals.

    Lighting Issue
    Mike reported that he received a small sample response from the subdivision in regards to his article requesting resident input on the current subdivision light.  Despite the number, the overwhelming response was in favor of the current design of the lamps. There was insufficient information from the sample as to the residents’ concerns for ongoing maintenance.  Mike has received a thoughtful response from Mr. Ken Seger (763 Haw Thicket Lane) and Mike will contact Mr. Seger to request his input and assistance in developing a master plan for the lights.  Mike will report back to the Trustees by the May meeting with his recommendations.

    Lake Issues
    The Trustees recommended that Carel Reynolds and Mike Lohuis (and the Lake committee if Carel and Mike desires their input) be asked to advise on the design, purchase, and implementation of the aeration system that has been previously discussed.   Prior to the implementation of this system, John will speak with Joe Odgers or Bill Ward to learn more of the use of copper sulfate to control surface algae. 

    Miscellaneous Issues
    Cindy Stanley will be asked to advise the Trustees on the assessments that other subdivisions in this area charge their residents.

    Brian, John, and Bob will install electrical and water outlets in the playground for future recreational uses.

    Addendum submitted by Bob Butterworth 3/10 p.m.
    I would like to make an addition to the meeting minutes. I received a new bid in today's mail. Cedar Treatment Services Inc. has given us a bid of $3390.00 to: apply a light chlorine solution to the Des Peres Road fence wash both sides of the fence protect shrubbery mask and protect the brick apply TWP Cedartone Natural remove all debris and related trash guaranteed for one year. This bid offers essentially the same service as Bartlemass, but at a savings of $1578.00. I'm thinking let’s go with the lowest cost. This is a legitimate painting company and will do a good job. The terms are 10% deposit ($339.00) due within 30 days, 30% at the start of work ($1017) and the balance due upon completion ($2034.00). If we go with Cedar Services, I'll call them and see if we can get an extension on 30 days for deposit and tell them we won't have the cash until the June timeframe. Comments?

    Dougherty Lake Subdivision Board of Trustees Meeting
    Monday January 22, 2001 7:00 PM

    This meeting was held at Brian L’Hommedieu’s home.  John Steuterman, Brian L’Hommedieu, Carel Reynolds, Mike Lohuis, and Bob Butterworth attended the meeting.

    Brian reported on the lighting allowance issue, specifically addressing the amount given to Mr. Raczkiewicz.  An official agreement was drawn up in 1996 and Brian shared it with the group. This agreement does not allow him to pay no annual assessment as previously thought. The change will be sent to Larsen’s office for the 2001 billing.

    Brian gave a report on our financial situation.  Because of the high expenses from the work done in 2000, we have only approximately $7000 to work with until the assessments come in later this summer.

    Mike Lohuis reported that the high lighting company bill was due to non-productive trips. Several times they came out to do work but could not because they could not find anyone home. Mike is searching for a new company to repair the 4 broken lights in the subdivision. He is also working on a lighting proposal from Ameren UE to improve the lights in the subdivision. This project will involve a substantial amount of investigation and reporting to the entire subdivision. He will report back on his findings.

    John reported that Gerber would start up soon, billing us monthly. Their annual maintenance contract is between $12,000 to $15,000. John suggested we contract with them to remove the fence at the west end of the lake at $300, and to cut back the burning bushes in the park for another $300. It was agreed that because of our financial situation, the Trustees will take on removing the fence and Gerber will be hired to cut back the bushes. No cul-de-sac work will be necessary this year. Nancy Powell will continue to handle planting the entrance.

    Carel reported that 4 lake projects are still unfinished: 2) Repairing the cracks in the dam, 2) Repairing the concrete spillway, 3) Re-galvanizing the metal grate over the spillway, and 4) Installing an aerator in the lake.

    It was decided that the cracks and the aerator take precedence this year. Carel will obtain bids on both and report back.

    Other expenses coming up are $5000 to paint the fence along Des Peres Road, $450 to repair the fence along Des Peres Road, and painting Sylvia Paletta’s fence along the park (cost unknown). Bob Butterworth will take on these projects.

    John approved Sylvia Paletta’s new fence and John and Brian approved the Funkhauser pool plan.

    Carel will begin work on the spring edition of the newsletter, with all Trustees’ input. 

    John made a motion that we continue using a court stenographer for our annual meetings, all agreed.

    Our next meeting is scheduled for Sat, Feb. 10 at Coco’s. The meeting adjourned at 9:00 p.m.

    Dougherty Lake Subdivision Board of Trustees Meeting
    December 5, 2000

    This meeting was held at John Steuterman’s home.  Charles Schrock, John Stueterman, Brian L’Hommedieu, Carel Reynolds, Mike Lohuis, and Bob Butterworth attended the meeting.

    Joe Odgers stopped by to take pictures of the 2 new trustees for the web site. All of the trustees thanked Joe for his work on the web site.

    Discussion took place regarding the assessment questionnaire received from City and Village Tax Office. Several lots pay less assessment because of streetlights they pay for. John recommended that we appoint a committee to address this issue, but Brian offered to look into who pays what and report back.

    Mike asked for a clarification of the duties of maintenance. John explained that it included grounds maintenance, landscaping, water, lights, fences and the playground. He explained that the goal of the maintenance function is to keep the subdivision looking nice but not necessarily spend excessively.

    John reported that a section of the Des Peres fence is broken. He has asked for bids for repair. He will also obtain bids for painting the fence this spring.

    It was decided that our next meeting would be a budget meeting. Brian asked that everyone submit his or her 2001 expected expenditures prior to that meeting so that we can look at the entire budget for 2001.

    Charles reminded everyone that we need to follow the Funkhauser agreement closely since action is required in 4 years.

    The trustees thanked Charles for a job well done during the last 3 years. Charles then left the meeting.

    John moved that we resolve to meet monthly, and it was agreed that, for the most part, we meet on the 2nd Saturday of each month, except for August. Carel will send out the dates for the 2001 meetings and will also follow up with a reminder each month. Brian moved that we each submit additions for the agenda to the Chairman 2 weeks prior to each meeting.

    Our next discussion was to appoint trustee positions. Mike asked us to explain trustee duties.  Duties of the president are to put together meeting agenda’s, run all meetings, and correspond with attorneys. Carel recommended that we eliminate the word “president” and instead refer to that position as Chairman.  Everyone agreed. 

    Maintenance handles all issued pertaining to grounds, maintenance, landscaping, water, fences and playground. Treasurer pays all bills and submits reports at all meetings, and the secretary takes and maintains minutes for all meetings.

    John requested that the two new trustees be assigned maintenance under him, as the position of maintenance has grown into a very large area of responsibility.  In lieu of that, Brian agreed to take the positions of Chairman and Treasurer. It was agreed that all trustees would sign off all expenditures. Carel agreed to stay on as secretary and will continue with her newsletter duties and lake committee chairman duties until the lake work is finished.

    Dougherty Lake Subdivision Board of Trustees Meeting
    November 11, 2000

    This meeting was held at the Coco’s Restaurant on Lindbergh.  Charles Schrock, John Stueterman, Brian L’Hommedieu and Carel Reynolds attended the meeting.

    John reported that Bob Butterworth has agreed to run for the Trustees. We will continue our search for a second person.

    We discussed the issue of the Ostermueller objection on the Cook’s proposed room addition.  Everyone stated that they had gone to the site to review the situation visually and that we had reviewed the plans that the Cook’s submitted and that the City of Des Peres had signed off on.  It was agreed upon that the Cook’s plans meet with the subdivision's restrictive requirements. Carel will send a letter to the Cook’s approving their plans, with a copy to the Ostermuellers.

    Don Sullivan submitted plans for a new bay window on his house and we approved it. Carel will send a letter of approval to him.

    Chuck Schumacher submitted plans for a room addition and we approved it. Carel will send a letter of approval to him.

    Sylvia Paletta submitted a request for a new fence. Carel will send a letter to Sylvia requesting that she submit plans for her fence to any of the trustees for approval.

    During a discussion on the expenses we have incurred during the past year, it was the consensus of the group that we raise the assessment to the maximum amount allowed according to the cost of living and within our indentures.  That amount calculates to $187.50. Charles made a motion and Carel seconded the motion that we would raise the assessment to $185.00 even.

    The City and Village tax office has requested extra copies of our indentures. Carel will see to it that they receive extra copies of the new indentures after the annual meeting.

    John reported that UE-Ameron will install new dusk to dawn lights in the subdivision if we wish.  They would also allow us to finance it over several years. Carel and John will put together a proposal for the subdivision to discuss.

    John shared the Gerber/Brinkman proposals for lawn care and maintenance. It was agreed that we stay with Gerber and that John should keep them under budget.

    Another complaint was issued regarding the grass (or lack there of) along Des Peres Road.  It is very difficult to grow grass without sprinklers and sprinklers are very expensive.  In lieu of the expenses we are already facing this year, this issue has been tabled for now.

    Charles will put together an agenda for the annual meeting and get it to Carel. Brian will submit a treasurer’s report to Carel and she will copy both as a handout for the annual meeting. Carel will arrange for a court reporter for the annual meeting and Charles asked that we have a podium with microphone and easel stand there as well.

    The subject of transition of trustees came up and it was suggested that we need to spread out the term of at least one of the current trustees to make the transition easier. We currently have 2 new trustees coming on board in 2000 and in two years we will have 3 new trustees coming on board in 2002.  A solution would be to have one of the latter 3 trustees extend their term by one year so that we only have 2 new trustees coming on board in 2002. We will continue the discussion at a later date.

    Our next meeting will be the annual meeting on November 14.

    Dougherty Lake Subdivision Board of Trustees Meeting
    September 13, 2000

    This meeting was held at Charles Schrock’s home.  Charles Schrock, John Stueterman,  Brian L’Hommedieu and Carel Reynolds attended the meeting.

    Charles reported that our attorney is leaving Ziercher & Hocker and going to Blumenfeld, Kaplan & Sandweiss. He asked if we wanted to stay with the same attorney or same law firm. Our decision was to stay with the same attorney. Charles will notify him in writing.

    Upon discussing the lake situation, Charles motioned we deplete the general fund before we hit the lake/dam CD. John seconded the motion.

    In planning for the subdivision lake meeting, it was suggested that Carel put together a list of all of the experts we called on, including the lake committee.  He plans to recognize especially the lake committee for their work.

    Carel reported that Tiny Jackson planned to use trucks that hold 10-12 yards of dirt for the dirt removal.  He will try to remove as much as possible, but it will depend on how wet the dirt is. Our hope is to remove 350 to 450 yards of dirt.  Charles suggested that we contact a competitive company for a bid for dirt removal. John will contact Budrovich.

    Because we have run into problems finding someone to take our dirt, Charles suggested we have a new sample tested to verify the oil contamination. He and Brian will take another sample and send it to the testing lab. Charles will also call the lab to verify what they saw in the dirt.

    Charles put together an agenda for the lake homeowner meeting which Carel will copy for each homeowner attending. She will include the list of experts and map of the lake.

    The damage to the fence on Des Peres Road, which was caused by a tree falling, was brought up. John will contact the homeowner and ask what he plans to do to repair it.

    Charles shared that he will be out of the country from September 25 through October 25.  He asked Carel to send out the Annual Meeting reminder via Larson’s office. He also suggested that we hire a court stenographer for the annual meeting. Carel will follow up on price and availability.

    Dougherty Lake Subdivision Board of Trustees Meeting
    August 26, 2000

    This meeting was held at Charles Schrock’s home.  In attendance were Charles Schrock, John Steuterman, Brian L’Hommedieu and Carel Reynolds.

    Lake
    Carel reported that we had not received the analysis on the dirt from the lake yet.  John motioned that we need to complete that testing to be able to report back to the subdivision the actual costs of removal of dirt.

    Carel reported that the survey of the lake had not yet been received. She will continue to follow up.

    Questions came up regarding dredging the lake. Do we need permission of each homeowner since it is their property in the lake? The suggestion was that we do need their permission. Carel will submit a letter to each homeowner on the lake and ask for their permission in writing.

    Regarding moving the dirt to St. Gerard, John will contact EPA and obtain permits needed.

    Status of the wall came up.  Carel shared the current consensus of the John, Brian and Carel. A short wall on the west side along the common ground would allow us to move some of the dirt to that side without having to remove it totally from the lakebed, which is more costly. Charles requested that we have Tiny submit a plan for proper footings, etc. Brian suggested we stake out where we want the wall to go so that we can get an accurate price from Tiny for the length we need.

    We need to begin preparing for the September meeting.  All future information regarding the lake should be shared with the homeowners via the website, i.e. soil sample results, survey results, wall results, etc.

    Landscaping
    Gerber will begin to take over cutting grass this month.  They are currently weeding, fertilizing, etc. Landscaping costs will be approximately $10,000 annually. John would like to add water and electricity to the park in 2001.

    Carel asked the trustees if trees between the sidewalk and street are private property, and all agreed that is true.  Carel will contact Missy Goodwin as she has a tree that is in poor condition that she wants to cut down.

    The dead trees in the park are scheduled for removal in September per Charles.

    Lighting
    Schaeffer Electric changed all lights at the lake. The balance of the lights are in the process of being repaired. 

    Picnic table update
    Paul Free, the concrete contractor promised to get the pad poured soon. Brian is following up on this.

    Fence
    Fence damage from the storm last week along Des Peres Road needs to be addressed.  It is our opinion that the homeowner is responsible since his tree fell on the fence. John will send a letter to the homeowner asking their intentions.  John made a motion that Charles ask the attorney to write up a directive for easement for the repair and upkeep of the fence. John also motioned that we not impede on private property until that is done.  John suggested that we hire a contractor to do the work on the fence because of our legal liability regarding damage and/or injuries. 

    Miscellaneous
    Carel shared Joe Odger’s CPI report with Charles.  He will work up verbiage for changes in the assessment at the November meeting.  The lake committee had suggested a sinking lake fund for lake repairs.   It was suggested that that is hard to justify. Why not just raise up the assessment as high as possible.

    Brian reported that only one homeowner has not paid their assessment. Official notice has been sent to them.

    Carel will put a sign at the entrance advertising the September 19 and November 14 meetings. We will have to send a formal meeting notice 30 days prior to the November annual meeting with items people are being asked to vote on.

    Dougherty Lake Subdivision Board of Trustees Meeting
    June 26, 2000

    This meeting was held following the joint meeting of members of the Lake Committee and the Trustees.  Those present for the Trustees' meeting included: Trustees, Charles Schrock, John Steuterman, Brian L’Hommedieu and Carel Reynolds

    1) Make final decisions on direction for the lake work. Develop an action plan and timetable.
    Based on the input from everyone, it was decided that for now we would simply move the rocks back under the spillway, clean out the two spillways at the south end of the lake, and smooth out the high spots in the lake. Carel Reynolds will talk with Tiny about coming in through Beaver Dam instead of Chuck Toedtman’s yard to save expenses. Carel will also obtain a price for the above-mentioned work from Tiny.
    Brian recommended we go forward with installing the aerators and everyone agreed. It was asked what we do about installing a boat ramp, which Chuck Colby requires to do the work.  Carel Reynolds will ask Tiny Jackson for a bid to install a ramp.  It was suggested that the lake committee take control of the process for this work to be done by September 1, 2000 and plan to meet with Charles Schrock by August 1, 2000 to discuss the process in detail.

    2) Brian will present a succinct synopsis of spending over the past 6-7 years, as well as our current financial reports to present.  Brian’s report was very detailed, and we thanked him for his work. It was suggested that he reword the financial report to reflect the CD separately from our active account.

    3) Other business

    a) Maintenance.  Charles Schrock shared his experiences with Mark Holterman in the past. Based on various conversations between Mark and Charles regarding how busy Mark is and how he is unable to do the work required, it was decided that Mark would no longer work for the subdivision. Everyone was asked to help locate a new vendor for this work.  John Steuterman had already begun the process of contacting companies.  Charles Schrock will hire teenagers in the subdivision on a temporary basis.
     b) Lights.  Bill Ward reported that he was having problems getting Des Peres to pay for the wires they cut doing concrete work. Originally the alderman said yes, but the city is now saying no. John Steuterman will contact our alderman.  There is also a light out in the park. Charles Schrock will call Schaefer Electric to have it fixed.
    c) Sprinklers.  Brian L’Hommedieu will contact the Sprinkler Company and ask them to fix the broken sprinkler along the lake.
    d) Tree mulch in common areas.  John Steuterman will contact the mulch guy to have the trees mulched in the common areas. When we find a permanent company to do our yard work, we will ask them to address the area along Des Peres Road which is constantly muddy.
    e) Lake shore clean up.  Carel Reynolds suggested we hire someone to clean up the shore while the water is down.  It was agreed that she would contact teenagers in the subdivision to do the work as soon the lake dries up. It was left to her discretion as to how much to pay them for the work.
    f) Other items.  John Steuterman would like to have the guardrails and new split rail fence painted. He will contact a painting contractor to do the work. 
    It was decided that the painting of the fence along Des Peres Road would have to wait until winter because of the flower and bush growth in summer. It was discussed again that we need a formal process to access the fence for this work.  Charles Schrock will contact our lawyer to obtain verbiage for this process, which would be presented to the homeowners and voted on at the fall meeting of the subdivision.
    Charles will send a copy of the Funkhauser decision to all homeowners via Roger Larson’s office. It was discussed whether or not we need to reword the restrictive agreement as it pertains to this issue. We decided we would address it at the next subdivision meeting for everyone's input.

    Dougherty Lake Subdivision Board of Trustees Meeting
    April 8, 2000

    This was a combined meeting of the Dougherty Lake Trustees, lake front property owners and Lake Committee members.

    Trustees present: Carel Reynolds and Charles Schrock. Lake committee present:  Carel Reynolds, Joe Odgers, Jim Harris and John Ahrenbeck. Residents present:  Mike Lohuis, Paul Devantier, Jim and Anita Marcuk, Stanley Niemoeller, Don Sullivan, Tom and Rita Rengel, Peggy and Joe Odgers and Chuck Toedtman.  The Clayton’s were unable to attend. The 2 homes on the west side of the lake were not invited because they do not share the retaining wall, however, it was suggested that they be brought into the conversation simply because they might want to do something when the lake is dropped. Carel will contact them.

    We are extremely fortunate to be living in a beautiful community with plenty of mature trees.  Those of us here today are especially fortunate to also enjoy the wonderful view of Dougherty Lake.  It is our goal as a committee to ensure that the view remains beautiful to be enjoyed by all of the residents. 

    Has everyone assessed their section of the lake wall?  How much time do they feel is needed to accomplish repairs? Does anyone need help finding a contractor to help them?

    It was determined that some walls need a lot of repairs and some need very little. Several liked the concrete wall Joe Odgers installed, but many did not.  Because the Trustees would like to see consistency in the wall, Carel Reynolds suggested that the lake committee coordinate the work with one contractor and was seconded. Residents asked that 3 bids be obtained and Carel Reynolds offered to contact several companies to obtain bids.  These companies would then work directly with the homeowner on their portion of the bid and after that is completed, a company would be selected to do the work. The questions was also ask whether we need to have building permits to do this work, and Jim Harris offered to check on it. 

    Date for lake drop - June 19 to July 17, 2000 (tentative based on weather)

     Everyone agreed that this is the best time because it is dryer.

    What the lake committee will be doing during the lake drop:

    Hire a survey team to survey the lake to determine a base line for the future.  With the help of a lake expert, obtain a sample of the silt and determine how much silt (if any) needs to be disposed of and the cost. Is there any possibility we could just move the silt around to even out the lake depth.
    It was suggested that we obtain several bids for this work and we assured them that we are doing just that.  We explained that we hope we are able to just move the dirt around and not be forced to haul dirt away.

    If silt needs to be removed, determine time of removal and method of financing. This information will be submitted to the entire subdivision at the September 19 special meeting. They could then make an educated decision on how they prefer we proceed during the annual meeting in November. We could then (hopefully) complete the work next summer.

    We shared the dilemma we have in convincing the entire subdivision that they would have to help pay for the work on the lake; thus the need for the special meeting in September to prepare for the vote in November.

    Jim Harris mentioned that we were looking into purchasing and installing an aerating fountain in the lake to help improve the health of the lake. Most people liked the idea. Before we can decide on this, we will need to see how much the lake work will cost. It was tabled for future discussion.

    Dougherty Lake Subdivision Board of Trustees Meeting
    Saturday, February 26, 2000 – 9:00 a.m.

    This meeting was held at the Coco’s Restaurant on Lindbergh.  Charles Schrock, John Steuterman, Bill Ward, Brian L’Hommedieu and Carel Reynolds attended the meeting.

    Charlie reported on the status of the Satellite Dish.  The Dept. of Public Works for Des Peres issued the permit for the disk with the understanding that the homeowner would conceal the dish from view.  This has not happened and Charlie asked that they (Public Works) enforce the rule.  John Steuterman suggested Charlie call Rick Lohr (who is running for office) if nothing happens.

    Charlie suggested that the split rail fence, which runs along the property lines on the east and west sides of the lake along Beaver Dam, needs repair.  Bill Ward will obtain bids for the work.

    Charlie reported that he had been unable to get a response from our attorney regarding the Funkhauser lawsuit.  John Steuterman suggested we push the issue with the attorney or get a new attorney from the same law firm.  He sited several reasons that we have grounds to pursue.  1)  It is our opinion that the decision to not pursue the lawsuit should have been made by vote of the entire subdivision.  2) The board of trustees was in a state of transition with the old going out and a new board coming on at the time.  3) We received poor direction from the judge in carrying out our end of the lawsuit.

    John also suggested that we add new language to the indentures so as to avoid this in the future.  This will have to be voted on at an annual meeting.

    John reported that Cindy Stanley has asked several people to help her with the new directory.  We need to make sure every resident is in the book, whether they want to be or not.  We need to make sure the letter that goes to the residents states that clearly.  (i.e. We are putting together a directory of the residents of Dougherty Lake.  If you want to add additional personal information, you may do so at this time through this form.)  Carel suggested the letter be included with the newsletter for ease of distribution.  John will follow up with Cindy.

    John will write an article for the newsletter to better explain our position on being considerate of your neighbors before making major improvements to your home. 

    John asked whether the fence along Des Peres Road needed to be painted on a yearly basis.  It was agreed on that every other year was sufficient.  We do, however, need to find out how we access the fence on the inside through the property owners' property.  Charlie will check his files to see what was set up in the beginning.

    Carel reported that Joe Odgers had obtained several bids from survey companies and was checking into what each bid covered.  The lake committee decided that the best time to drop the lake would be the week of June 1.  Carel will put this information in the newsletter and send letters to all residents along the lake asking them to check their wall and determine if it needs repair.  If so, the best time to make repairs is at the time the lake is dropped.  There was also some concern about Joe Odgers being the only person who knows how to drop the lake.  We need to have a back up person “just in case”. 

    John suggested we check into an aerating fountain for the lake.  Would it help the lake's health and how much would it cost to install and maintain?  Carel will ask someone from the lake committee to obtain that information.

    After the lake is dropped and surveyed, we will call a general meeting of the subdivision to share our findings and propose an action plan.  This should take place in early September.  The residents would have until the annual meeting in November to consider our proposal and cast an educated vote on the appropriate actions and payment plan.

    John suggested we do something with the cul-de-sacs in the subdivision.  Several of them are starting to look bad.  Charlie suggested we ask the horticulturist who planted the entrance for ideas and then hire Mark Holterman to maintain them.

    John asked Carel to add information to the newsletter regarding our leash law and pooper-scooper law.  He also suggested we let the residents know how to obtain permission for work to be done on the outside of their homes.  All they have to do is submit a copy of their plan to any of the trustees and we will respond within 7 days.  It would only take approval of 3 of the trustees to accept or decline a plan.

    Bill is still having difficulty contacting Yard Bright to fix our lights.  He will continue to pursue.

    Brian contacted City and Village Tax Office and they agreed to drop the fee to 5%.

    Regarding cars being parked across the sidewalk (which is illegal), John will contact the Des Peres police to enforce the law. 

    Our next meeting will be at Charlie's house on Wednesday, March 15th at 7:00 p.m.
